Con Agra/ Contaminated peanut butter

Anderson & Horne, PLLC has filed a class action against the
appropriate parties in the name of Ernest J. Wallace, Jr. for
himself and all others similarly situated vs. Conagra Foods, Inc.
We represent Mr. Wallace as the Kentucky class representative
and represent your interests through your potential membership
in the class. Unlike an individual lawsuit in which a person sues
on behalf of himself or herself alone, a class representative has
duties and responsibilities of acting on behalf of the entire class
of persons who share similar claims in this matter. Unlike an
individual action, a class action cannot be settled or dismissed
without court approval and only after the judge is convinced the
settlement is in the interests of the class.
While we do not represent you individually the following
information is provided as a courtesy:
The Kentucky Class action was filed in the Jefferson Circuit
Court and has now been removed to the United States District
Court for the Western District of Kentucky, Louisville Division,
and styled ERNEST J. WALLACE, JR, for himself and all others
similarly situated vs. CONAGRA FOODS, INC. Cause No.
3:07-cv-00173-JGH. We have asked the Judge to send us back
to state court, which would make the case move more quickly;
however, it is completely up to Judge Heyburn. There has also
been some action by ConAgra and others to move the case to
the United States District Court for the Northern District of
Georgia where the ConAgra plant implicated in this action is
located. Until these matters are resolved there will be little to
report. There is nothing more to report at this time.
In the mean time you should preserve any evidence you have
such as the Peanut Butter, receipts or medical records.
